Because Jail SUCKS!
When a loved one is arrested, you likely want to get them out of jail as quickly as you can. However, most people do not know what to do to get a loved one out of jail after an arrest. The guide below walks you through tips to follow to make getting someone out of jail as easy as it can be.
Determine Where Your Loved One Is Located
When your loved one calls to let you know that they have been arrested, ask where they are located. You will need to contact the jail directly to gather pertinent information you will need in order to get your loved one out of jail. Knowing where the person is detained allows you to know where to call after they hang up the phone.
Determine What Their Booking Status Is
After you get off of the phone with your loved one, call the jail where they are detained. Ask what their booking status is so that you know whether they can be released in the near future. The police must document vital information about your loved one, and that can take time.
Determine What the Charges Are
When someone is arrested, they are charged with specific crimes. When you talk to the officer, ask them what specific charges are being brought against your loved one. Some charges are so heinous that the authorities don’t allow the accused to get out of jail on bail, but with many crimes, people are allowed to post bail so that they do not have to wait in jail until their court date.
Prepare to Give the Full Name
If your loved one is able to get bail and you know that you are not going to be able to afford to pay for the bail on your own, you may need to hire a bail bondsman. The bail bondsman will need your loved one's full name. You need to know the proper spelling of the name so that your loved one can be properly identified.
Discover the Bail Schedule
In each jurisdiction, there is a bail schedule that indicates how much the bail amount is for each crime that someone can be charged with. You need to go down the list to determine how much the bail amount can be for your loved one based off of the crimes they were charged with upon their arrest.
Prepare to Put Down Collateral
When you get a bail bond, you need to have something of value to put down as collateral for the loan. You can put down the mortgage on your home, the title to a car or other things of value as collateral for the loan. If your loved one chooses to not go to their court appointment after they are released, the court will consider your loved one to have jumped the bail.
If your loved one jumps bail, then the bonds company will lose the money they put down for you. As a result, you will be responsible for repaying the bail bonds company. To regain the lost funds, the bail bonds company can then take possession of the item that you put down as collateral for the loan and sell it to recoup the money they have lost.
Do not bail anyone out of jail if you think there is a chance they may flee. You could lose your home, your car, or other valuable property as a result.
